What is the name of your state (only U.S. law) WI
Back in Dec my 66 year old mother purchased a car from a local dealership. To start off with the person who did the paperwork for told my mother that the loan company who would be handling her loan required that she purchase a power tran warranty for the car. She agreed and allowed it to be placed on the loan, because she believed him.
Two weeks ago the person from the dealership called her up and said she needed to sign a new form for the warranty because he had used the wrong form and could she please sign it and send it back to him the same day. A couple days later she recieved a letter in the mail from the company that the warranty (which was actually a service contract) stating the car did not qualify for the the service contract because it had too many miles on it.
She then called the bank where the loan is through, (its in a city over an hour and half's drive from here) and was informed that they do NOT require a power tran service contract to get a loan. What made us suspious was that the term for the service contract was only two years but the term of the loan is three years. If it was a requirement of the bank why was it for only two years then?
She called the dealership back up and told them what she found out and said she didn't want the service contract and to send the money back to the back to bank to be applied to her loan. The guy at the dealership said he would have call the bank himself and find out if they require it. She told him that she already talked to them. He said he would look into and get back to her.
After two days he did not call her back. So she called the company through which the service contract went through and asked where did they send the money. They stated they had sent back to dealership three weeks ago. She called the bank, no they had not recieved the money yet.
She called over to the dealership they didn't know where it was, but they would look into and get back to her. They just called a few minutes ago and what they had done was sent the money already back to the service warranty place under a "different catagory", she had not signed any new contract, yet they spent the money anyway. Supposedly they are getting it back from the company and will send it to the bank by the end of this week.
This all seems so fishy to me and like they are trying to take advantage of her because of her age.
