What is the name of your state? WASHINGTON

Below Paragraph 3 from RCW 26.19.090.

My reading of the below paragraph leads me to conclude that one does not have to pay Post Secondary Educational Support to a College age Child while that Adult Child is not enrolled. I read this to say that I am not obligated to support during periods such as: Summer Break, Winter Break, Spring Break, Breaks between Quarters/Semesters. I would say, obviously, weekends DO NOT count...ie I do pay...I guess. What do yee all say????

I have a Court order in hand and WILL live up to it's obligation. This said, the Commissioner that ordered the PSES told my ex and myself to follow RCW 26.19.090. The Commissioner ordered me to pay my wife back for July - September for PSES - no problem. Yet, my son had a three or four week break in late August between Quarters and went on a walk-about to California. This walk-about is OK with me but should I pay him for this time he was not "enrolled" in school??????

(3) The child must enroll in an accredited academic or vocational school, must be actively pursuing a course of study commensurate with the child's vocational goals, and must be in good academic standing as defined by the institution. The court-ordered postsecondary educational support shall be automatically suspended during the period or periods the child fails to comply with these conditions.

Sorry, but I think you are grasping at straws here. I don't think that a judge would consider normal school breaks as "failing to comply with these conditions".

:rolleyes: If he took a quarter off, then support would stop it doesn't apply to the breaks in between terms. Come on you are almost there just write the check.

I would have to agree. When he was in high school, you didn't stop paying during summer & other breaks, did you? It looks like the same type of situation.

Intutitively I would agree but this is PSES and not support for a Minor. In fact the Commissioner wrote in our order that my 18 year old has to proof he has sought other sources of funds other than me. The order is only good until December. No one would ask a minor to find alternative sources of funds.

I thought I read somewhere that one does not pay between quarters/semesters????

You may have read it somewhere but that is not what the statute says, it is a matter of a short period of time and breaks vary between schools it would not be fair if one child went to a school structured with fewer terms and longer breaks or another was in a school with more terms and shorter breaks. If he took a term off that is different. If you didnt want to pay during breaks then you should have had that written into the order.

Of course the judge can ask him to seek other funding and provide proof just like they must provide proof of grades. If has nothing to do with being a minor, it has to do with post secondary education, that is, college and support during that time.

This is why your son is upset with you.
