What is the name of your state? California

My father is living in an Alzheimer's Unit of a convalescent home. My mother just passed away. My parents have no will. Can I get Power of Attorney over my father's estate without conservatorship?

A person with Alzheimers is NOT competent to sign a POA. You must petition for conservator.

That attorney is an idiot. Fire him/her and hire one that knows the law regarding incompetents.
