I live in New York and my brother lives in the Mid-West. My Mother is 77 years old and lives alone. My father died 6 years ago without leaving a Last Will and Testament. My brother and I are concerned that we will have one big problem on our hands when my Mother passes if she doesn't get a Last Will and Testament.

My question, what does my brother and I have to do in order to get Power of Attorney in Puerto Rico?? My Mother currently does not have a Last Will and Testament and has been dealing with an attorney who has personal documents of ours and has so far taken 3 years to get a "Declaracion de Herederos" (translation: declaration of heirs) without getting it done. Any help would be greatly appreciated. Thank you.
