I accepted an offer from a new company. Turned in a three week notice to my former company. Two and a half weeks before my start date I did all my paperwork, drug test, and four hours worth of training videos. Three days before I was to start they called and said that because I had a DUI on my record I could not work that particular position and there was nothing there for me. I am now out of two jobs because it was after I had finished with my former company. They also said that I will receive no compensation for my training time because it was "pre employment." Do they have to pay for that time? Are they allowed to with hold my background check information for two weeks when they said it would take 3-5 days?

They MAY be responsible for paying you for the time you spent viewing training videos; contact your state DOL if you wish to follow up on that.

As for the rest, you're probably out of luck. Just because they estimated it would take three to five days, doesn't mean if the company doing background checks hasn't reported to them in three to five days they have hire you regardless of the final results.
