I am an unsecured creditor in a bankruptcy case. I am being sued now for preferential transfer because I received partial payment of a Note (loan) that was due, on the date that it was due, sent to me within 90 days of the bankruptcy ruling. I had sent a demand letter for payment of the Note on the advice of my attorney. My financial manager had advised everyone who had invested in this company to demand their money back, as the company was having problems. So there was a "run on the bank," so to speak. Later investigation has shown that the company had been insolvent for several years. What are my chances of fighting this and winning?
