Primary vs Sole

What is the name of your state? Oregon, however the question is regarding California.

My friend asked me if Primary legal and physical custody is the same as sole legal and physical custody. She wants to move to Italy and she has primary legal and physical custody and wanted to know if she has to get her ex's permission to take the children with her.

Nope, it sure isn't the same. And yes, she's going to need Dad's consent to get them a passport and to move them out of the country.

Even if she had 'sole' legal custody it is unlikely that she would be legally allowed to move, let alone out of the country, without at the VERY VERY least having to inform dad. Some states REQUIRE court approval and some just require notification to other parent in which they are given time to be able to contest the move. 'Legal' custody doesn't always mean that you are no longer a parent.
