I had been arrested back in 1988 at the age of 19, for fighting. A few months ago I applied for a City job and got hired (on probation until Feb 09) and when I filled out the application they asked the following question:
"Have you ever been convicted of any offense other than juvenile, youthful offender, or a minor traffic violation?"

I honestly answered this question "no" because my record showed the status as "suspended". Yesterday, I got called into the human resource office re background check, and they questioned me about this arrest and they asked why I lied on my application. I told them my record stated "suspended" and I honestly did not know I needed to reveal it. They advised me that "suspended" and "Dismissed" are two very different terms according to the law,and by not putting the details of this arrest on my application, is grounds for me being fired. They ALSO found a misdemeanor from 1986 (age 17) from the state of NY for being pulled over for having nunchucks in the car(Which I honestly don't remember). They advised me to go to NY (New Rochelle) and check on this report.

My Question:
1) What is the difference between suspended and dismissed on my ct police record
2) Isn't there a statute of limitations for misdemeanor in NY?

I have worked many management jobs before and this is the first time in my life I have had a problem. I really love my current job at the City. They said once I check on the status of CT suspended and NY misdemeanor and bring the information back to them they will decide whether to fire me or not. They said if there is a warrant stemming from the 1986 NY misdemeanor, then I will be fired.

A: Dismissed means the case was never carried through; suspended means that there was some action taken possibly resulting in a conviction and that the punishment was suspended.



2) Isn't there a statute of limitations for misdemeanor in NY?

A: Yes, and it stopped running the instant you were arrested.
