Prisoner Rights? What can I do?

What is the name of your state? Florida

My question is regarding my cousin who is currently a prisoner here in the state of Florida. He is currently in a federal prison in Coleman, Florida. My question: is there anything we can do by getting a lawyer due to the following issues that are going on with him in the prison.

He has been put into confinement aka: "The Whole”. They are claiming that they have the right and are putting him in confinement for 9 months, and or he can choose to be transferred to the max security prison for the remainder of his sentence which is about 10 months. The thing is they are saying that they are doing this for several reasons. One being because he has refused to let them take anymore restitution then $30.00 a month from the money his family sends to him for phone calls and things he needs. His mother sends him only $30.00 a week and they are wanting her to send in even more so that they can take out $160.00 per month from him. It’s not his money , its hers for her son to use while in there and also I am sure that they can not make him pay restitution while he is serving a sentence in prison, if I am not mistaking I believe he was even told that at the trial from his lawyer at the time of sentencing. On top of that I don’t see how they can punish him for that. They also claim that he is remaining in the whole or being sent to Max security because he has violated his parole by being in prison for a prior little incident. I also don’t believe they can do that, he has not been seen before a judge on the issue of this violation of parole. We were told that there would be sheriffs there to pick him up on his release date from this prison to arrest him and take him to the county jail house for the issue of violating parole. He has been accused of taking another prisoners badge. Now we have come to find out from the warden of the prison, that he in fact did not take the badge but it was lost by the other prisoner and found. It was just that the prisoner who lost his badge blamed my cousin for taking it when he in fact did not. And now that prisoner is being punished for false accusing of someone taking his badge. They have had him locked up in confinement now for 12 days. I don’t see how they can do all of this. Is there anything that we can do to help him from out here? Are any of his rights being violated?

The BOP can do just about anything they want to . The money you send in can be taken for fines . I think it's 25 % every 3 months . Good luck to you .

Have you ever thought that there is MORE to the story than what he is telling you? I know he is your family member, and that you would like to think that he is in fact being truthful... but do you really know that? You might want to talk to his parole officer, but I doubt he or she will advise you.

I actually am friends with the Warden of this particular prison, and know that he is an honest and fair man.
We have NEVER discussed anything about any particular prisoner.

I know that based on what you are posting, your cousin is not telling you something. You don't go to the "Hole" unless it is deserved. The money can be used for fines. There are 3 levels of incarceration at the facility, and your cousin is either going to be moved from intermediaty to max, or spend quite a bit of time in the "Hole"...

They do have that right, and it was sweet of them to give him an alternative option. You are getting only one side of the partial story.

YES! You said it! The hole is for more than just fines and things of that nature. I believe that Simplicity's cousin is leaving out information; i.e., trouble he got into, fighting, etc. He is not telling her the whole story. But then again, he is a convicted felon... lying and manipulating is what they do best.

They can put you in the "SHU" for anything they want to . Seg. housing unit . Great legal advice ...by the way . Are there not moderators here ? Sheeeeeeez .

I know what the SHU is... I work in an institution. I also know that convicted felons tell lies and manipulate. Do you know that?

Yes , i'm sure they do . Do people that aren't " convicted felons " tell lies ?
Manipulate ? This lady is asking for help . Not to get slammed .
