I had laser surgery (prk) from Dr. Kansas in Albany, New York. My vision was only slightly off (-1.25). After surgery I was told I was healing nicely and if another doctor was to look at my eyes they wouldn't be able to tell that I had surgery. In November of 1999, I had experienced serious discomfort that wouldn't go away. When I called Dr. Kansas for visit, I was told he was unavailable for appointments but referred to Troy Eye Associates for a emergency review. I met with several doctors at that office over a period of 6 months - almost weekly before being diagonsed with recurring erriosion. I was told to use a cream at night before going to bed and to use regular eye drops 6 to 8 times a day. After a year of the discomfort continuing - I went to see a local doctor who is or I have been told the most experienced eye doctor in the area. After my visit, with Dr. Belin, he told me that I did not have recurring erriosion but I had serveral scars on both eyes from the surgery. I understood the surgery was not a guarantee as to the vision result but I had not idea that my eyes had or could scar. I was released from followups because I healed so well. Today, I am using a cream at night prior to going to bed. When I wake up my eyes are itchy and dry. During the day I use drops 6-8 times. My eyes are very dry and often tear extremely. They are always red, dry, and painfull. Do I have any recourse against the doctor who did this surgery. I have been told by Dr. Belin that scarring does occur but statistics show that scarring occurs with people with a higher corrective rate, such as -5.0.
Thank You.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Dont ever use names again == it may open you up to liability.

As to your situation, were you informed of possible scarring as a side effect of surgery? If not, would you still have had the surgery if you knew? Is this scarring only a normal side effect or could it only come from medical malpratice on someone with your level of vision?

These are questions you need to research. May I suggest you seek a consultation with a medical malpractice attorney. Try http://www.attorneypages.com
