Problem with provider not billing insurance

We have an ambulance bill from march of 2005, the ambulance co. submitted the claim to the wrong offic (is ppo plan) and the claim was denied. The ins. company called them on the phone and explained to her how to resubmit the claim properly. She said she would but to date she has never resubmitted the claim. Now we are getting bills from them again saying the insurance company never sent them a check and to please remit payment. They have not sent a check because she has never followed instructions to resubmit to the local office. I have done all my communication with my insurance compnay through emails, as to have documentation. I am going to write them a letter, complete with copies of the email communications I've had with the ins. company regarding the bill. What is my legal position on paying this bill out of pocket? Do I have the legal right to refuse to pay the bill until they resubmit it to ins? I've not had this problem before where a provider just expects me to pay it because it's easier for them to have me pay it rather than mess with the insurance paperwork. I have written documentation that they have not resubmitted, that ins. called them and explained the situation, who ins. spoke with at the providers office, that it cannot be processed through the office it was submitted to, although they have tried. What should I do?

Unless your insurance policy specifically says otherwise, your medical providers bill your insurance directly as a courtesy. It is your responsibility, not theirs, to see that the insurance company receives the bills.

No, you do not have the legal right to refuse to pay the bill until they bill the insurance. You, not your insurance company, has the bottom line responsibility to see that the bill is paid.

Call your insurance company to find out how to handle it. Ask them if you can pay and get reimbursed from them directly. They will tell you what the procedure is.
