A situation happened to me three months ago and I am currently looking into what I can do with this.

I moved into an apartment complex in June of 06. I signed up for electric service with Gexa Energy, per the recommendation of the apartment manager. When I signed up, I told them apartment 316. They deducted the security deposit from my credit card. I never recieved a bill from them but I was being charged for electric service through my apartment complex and I was paying them directly since they were the ones charging me.

On December 13, 2006, I come home from work only to find a letter attached to my door stating that I had not signed up for service as required and that my electric would be shut off if I did not sign up for service. I called Gexa, but was on hold for over half an hour, and I just said forget it. I then got online and signed up with Green Mountain Energy. It was approved within a day. I took the confirmation letter to my apartment manager and she cancelled the disconnect order. However, on Friday, December 15, I come home from work and my electric is shut off. I went to the apartment manager and she finally got Gexa CSR on the phone.

What happened is that when I signed up back in June, whoever it was that put my order into their computer, put #1316 instead of #316. Gexa fully admitted to this during my call. They said that they would get it back on within 24 to 48 hours. It did not get turned on until Tuesday, December 19. Five days later.... And when Gexa had it turned back on, they took it back from Green Mountain without my permission.

Gexa fully admitted that they were wrong and even offered to pay for any food lost. But I feel they should have to pay a lot more than just the lost food. I feel that in addition to the food, I should at least get my deposit back(since they did not fulfill their end of the agreement as stated), reimbursement for loss of basic services(hot water,etc...) and a per-day penalty for their mistake.

I am just wanting to get any ideas from you guys about what I should/could do about this and possibly how much I should see if I can get. They were in the wrong and fully admitted to it. Just wondering if I should see if they will pay willingly or if I should get an attorney for this? Anything???
