I have a two year old dui bench warrant, I was wondering if there is a way to file a petition to recall or quash a warrant in California. Specifically fresno county. I just want to resolve the situation with out going to jail or paying a bunch of money. Thanks

Jail you can likely avoid. Paying a lot of moeny is harder to avoid.

Call the court and see if you can schedule an appearance date. You probably would want a lawyer anyway.

So in other words you want the warrant to just go POOF without paying a penalty of any kind. You're kidding, right?

Get an attorney and pay him a "bunch of money" and maybe you can lessen the effect of the whole mess you created for yourself by having the warrant issued to begin with.

If it were a simple civil violation, you likely could just pay it (in many counties online) along with the civil penalty for FTA and then go deal with the DMV.

However, being charged with the crime of DUI, you're likely going to have to make an appearance. You're going to want a lawyer for the DUI charge, and the attorney can arrange an appearance that will be more convenient than being randomly arrested.

There are several attorneys who post to this forum. The majority of forum volunteers, however, are not attorneys. They just have a good working knowledge of the law due to their jobs or their experience. Please re-read the terms and conditions of this site that you agreed to when you registered, or read the NOTICE that appears on the bottom of every page of the forum.

You also should re-read what FlyingRon advised. It was good advice.

You will want an attorney and the article explains some of the reasons why. If you try to do this on your own, there is a likelihood you will spend some time in jail. If you turn yourself in with the help of an attorney, you might escape jail time. I doubt strongly that you will escape paying a bunch of money either way.

How does it feel to want? You're the one who got arrested for drunk driving and then didn't appear in court as required. Now you think there is some magical way to get out of getting jailed or paying the high cost for your poor choices? :rolleyes::rolleyes::rolleyes:
