I recently purchased a lot of electronics from a company in Florida. Via phone and email, the seller confirmed that the goods were brand new. When they arrived, however, they were actually refurbished. I will be asking them to take the items back, but it is unlikely they will take it back.

1) My question is can I sue the company for misrepresentation of the items or anything else? I have copies of the email confirming that the items were brand new. If I were to sell these items as they were, I could probably sell them and take about a 1,800 dollar loss. Can I sue for the losses I incurred due to the items being refurbished?

2) Also, it sounds like this is a small claims? Would I have to sue him in Florida?? Or could I sue from here in California where our company is based?
