Hi I'm a caregiver in Arizona, caring for an elderly couple both 92 yrs old, he is a complete control freak & suffered from dementria, she was totally incapacitated, and to whom I was hired to care for. After 1 year & 10 months, he decided he didn't like me and told his neice (conservator) (and Town Mayor for last 11 years) she had 3 months to replace me, which, to my shock, she did within a week, and told me you are not fired, he will forget all about it and you'll be back before you know it, she totally disagreed with the reasoning, and said dont worry your going to get paid for the 3 months, treat it as a vacation, she'd mail my check every friday to me, I received 3 checks, then no more, before she stopped paying me, she asked me twice to sit with her elderly mother, when I showed up, she decided no, and sent me home. The uncle for some reason took a collectors key-ring, I had brought over to show them, and threw it, the neice said she would pay "price" for it, over $300., and some things I had bought and suppose to get reimbursed for but haven't. The couple had died last year, and I recently sent her a letter asking for the rest of my money, and reimbursments, I received a court paper from her lawyer saying "1.Your claim against the above estate in the amount of $(over 2k) has been disallowed in full. 2. Your claim will be barred unless you file a petition for allowance or commence a proceeding against the Personal Rep. within sixty days of the date of this notice". dated 4-13-05, I received this on 5/20/05 giving me a very short time. What would be the best route to go, file a petition for allowance, or commence a preceeding against the neice. There is nothing in writing, all verbal, I did sent her a follow up on the conversation, and she never said anything against it. What to do in such a short time??? I am very busy with 2 more patients. What will happen next?

I very much doubt that you legally are owed any money for time you did not work, unless you had a bona fide contract that guaranteed you three months pay no matter how long you actually worked. But I agree with the other poster that this goes beyond the scope of employment law and should be posted in the section s/he suggested.

Wow, thanks for directing me, I didn't know, or see where the 'probate and personal representatives' was located...but I do now... And yes longneck I was paid from their personal checking account, which also had their nieces name on it, all other properties, monies, was not in the nieces name...

Well going to that other place to post this ...thanks again.
