What is the name of your state? MN
Is there a SOL regarding a Promissary Note involving Real Estate? There was a Mortgage that was never recorded (I think the ex-wife swiped it). No payments had been made since 1995 .
This is a family issue....

Relevant Facts

Husband borrowed money from parents to buy home. He signed a Promissary Note and a Mortgage ( which was never recorded). His Father passed away in 1995 and his Mother told him that he didn't need to make any more payments.
She signed 2 notorized documents last year, indicating the loan was satisfied.
The understanding between the two of them was that he would leave the property to his children when he died. He did so, but left me ( the new wife) a life interest in the home, so that I would not become homeless.
His daughter is extremely upset that she can't have her inheritence until I croak and is trying to get her Grandmother to declare the Promissary Note valid and enforceable.
That way, I will be booted out, the home sold, and the daughter can get her money. I am trying to cover all the bases.

The note is irrelevant. Your life estate, unless you abandon it, is all that matters.

Tell daughter to get on with her life. You'll croak soon enough.

I won't comment except to ask why? Not that I agree but I think I know where you're going and although there is no mention of probate, even IF and when the estate is probated the life estate won't be affected.
