What is the name of your state (only U.S. law)? Indiana
The abandoned home next door to me was purchased by a real estate group. They are "flipping" the house and in turn have caused damage to my property. Their contractors have caused damage to my home and we are having difficulty having them repair it back to the way it was before. They are stating that it is the contractors responsibility, but my insurance agent states it is theirs. My question is, who is legally responsible to fix the damages to my home?

Why not file with your insurance and let them work it out with the owner and the contractor?

Alternatively, sue both the owner and the contractor.

Both.

But your insurance agent should handle this for you.

It happens to me too - not quite as frequently though...I'd label it as "occasionally".

Because the damage would fall under my deductible on my homeowners policy.

Is it relatively minor damage or do you have a huge deductible? If its relatively minor then go ahead and get it repaired yourself and then sue them in small claims court for whatever it cost you to get it done.

If its more substantial, you might want to go ahead and sue them before having it repaired, and then perhaps agree to settle the case if they get the work properly done within a certain, specific time frame.
