What is the name of your state? GA I surrendered my property in bankruptcy in April 2004 and the autmatic stay was lifted in June 04. The property was foreclosed on in October. I never received anything to move out, which I had already done anyway. The property is still listed in my name. Is this bad? How do I get this changed? I was at the auction and my property was listed but no one bid on it. I asked the person from the law firm handling the auction for my mortgage company what happens being no one bid and he says the mortgage co. gets it. I have read elsewhere that the mortgage company doesn't have to bid on it either and it could still be mine and I should try and redeem it through the courts for pennies on the dollar, which would force the mortgage company to take it or I'll get it cheap. Anyway, just wondering what may be going on here and what action I should take to get it out of my name or can I redeem it cheaply, etc. Thanks forany info.

What makes you think the land is still in your name if it has been foreclosed on?

Who told you that?

County records still shows me as the owner. Also, there was no dispossessary action filed to my knowledge. Like I said, I surrendered this property in bankruptcy and it has been discharged. I guess what I am worried is if I am liable for anything that might happen with or on the property, i.e a child comes onto the property and gets hurt etc. Thanks

If all of these statements are true, then you still own the land and it has not been foreclosed upon.

Ga. What should I do? I don't want the property. Like I said the debt has been discharged in bankruptcy so I am no longer liable for the mortgage. Can I lease it or move back in and live their free until they foreclose and boot me out? Thanks

Call the lender and ask them to prepare a deed to convey it to them.
