Facts: My Father married a woman 19 years ago. They resided in a home which was owned by her parents but they paid rent. Before her parents passed on they wanted to transfer the Deed to my father and his wife. My Dad took ill prior to the signing but the transfer went on leaving him off the Deed. Come to find out now, 2 years later, his wife also put her Daughter on the Deed. The double home is owned out right. During this entire marriage my Father has put this woman through school, helped with her teenaged kids that were still at home and brought this woman out of gutter...she didn't even own a coat when they got together. (Not sure what he saw in her, but it wasn't my choice.)

Situation: Their marriage is going down hill. Basically because her 34 year old daughter who's never been married still lives at home with them along with her child. She causes great problems and pays zero to live there. Don't want to bore you with their problems. Nevertheless, in argument I happened to walk in on, his loving wife was telling him that "you came into this house with nothing and you'll be leaving with nothing." I explained to her (since I went through a divorce and know much, not all but much) that since the house was acquired by her "during their marriage" that it is considered "marital property" as is everything they own. She went crazy stating he has no rights to anything, blah, blah. They have not seperated but she went last week and emptied all their bank accounts; this man is 66 and disabled for 4 years due to 3 heart operations can't even get a dollar out of his bank now. He does get Social Security and his retirement but has to wait until his next payments. They cashed in his pension 2 years ago and paid off their vehicles and other bills.

question Where does he stand? He wants to leave because he can't stand the mental abuse; but also doesn't want to lose the 19 years of money and work he put into making her mothers dump of a home into a nice home for her and her family.

Your father needs to get himself an attorney. This isn't something to handle by getting advice from an internet message board. There is too much money involved.
