My husband and I are discussing divorce. When we were married he had boats, a plane, condos....and put down a large down payment from the sale of his house to buy our new house. He now says that if he leaves me all that will remain his and his alone.
I wonder if during our marraige he spent a lot of money to maintain these items...does that make them community property?? He also added a lot of money to his IRA so what happens to that?
I'm not trying to be selfish but I don't spend much money, I am very frugal, while he spends most of our money on his toys.....
One more thing...he has a large trust with all his "things" including our house in his name alone....He has been kind of selfish about everything and I'd just like some information about what I have a right to if he leaves.
Thank you for any and all responses!

Massachusetts _ sometimes it depends upon on how long you`ve been married, or if any assets owned by your husband were actually "gifts" from a third party. Other than that, usually EVERYTHING martial is 50 -50 and that goes for his "toys" also. Whose "name" it`s in is irrelavent. You both agreed to this in your marriage "contract" called wedding vows. Good luck.

My response:

Darlene, I'd get into it with you, but you have way too many issues and categories to discuss. It would literally take me pages and pages to discuss all of the in's and out's with you on a forum board. So, I won't even begin.

However, I would strongly suggest that you arrange for a free initial consultation with a Family Law attorney near you.

Good luck, kiddo.
