property signed away and ???protective services findings

I hava an aunt who was refered to protective services and they saw her 6/22/05. She signed away prpoerty on 6/18/05 . she denies knowing what she signed. She seemed confused, unkept and ill when she was refered to protctive services. the neice who got poa had her sign over her house to her and has put up no trespassing signs and refuses to let her sister visit.
( there are 2 people she signed property over to).Her sister can only talk to her when the niece leaves to go to work.

Is there a way find out the protective services findings.If they found her confused?

people are afraid to call protective services again for fear that the neice that is care taker may get mean and take things out on her.

You will need to hire an attorney to obtain the records from APS.

Can that be done.
The attoney that is working on another isssue told us there is no way to obtain that information. I did not believe that.
Can an attoney just as for the information or does it need to be court ordered.

The most important issue for the attorney to deal with is to see if your state has laws against abuse of POA, which is what this POA seems to have done. Aunt can have a mental competency test done to verify the confusion. IF abuse of POA is occurring, attorney can get the POA voided and can also find out if this POA is using the money (by asking to see receipts) for expenses of the aunt alone, AND getting the transaction regarding the house reversed. And then she can pick someone else if necessary to be POA if she needs help with financial transactions.

Attorney can also help her draft a will so that she can decide who she wants to get the house.

Don't let fear of what the niece could POTENTIALLY do hold you back from acting. If niece gets that extreme, she's going to jail. If there is no one else in the family willing to help take care of her, then you need to consider some other arrangements for her care--could she afford to move into a nursing home or assisted living facility, or hire a home health care nurse/live-in helper?
