Right. It will take time for mricoo to get the towing and eviction issues resolved with his mother.

It can be a costly mistake for mricoo to leave his vehicle in the tow yard. There is no guarantee mricoo can recover from the mom the tow storage fees.

( retired) LLs suggestion...get the car out of storage ASAP to stop the charges from piling up.

IT is not exactly clear just who is your LL, It reads a bit like you were Moms subtenant ...and as such it reads like she forced you out without even being close to the required steps to do properly evict you....and the legal system frowns on such LLs which take law into own hands plus ...she may have violated law as to tow of your vehicle unles the property owner or law enforcement were notified in advance ...it's possible that you can make her conduct into a small claims action for your costs or even tack on your legal expenses as well ..but even if you win it may be darn hard to collect....may be less of a problem to suck it up and leave her behind .

The landlord (and mom) might not be covered by the VRLTA (and therefore not held to eviction laws). Although I agree the vehicle should be retrieved from the tow lot, mricoo needs to find out if the landlord owns more than two rental properties.

Hello, thank you for all comments while I was offline. I finally got in contact with landlord yesterday. My mom did tell her I was living there. The landlord had no knowledge of the situation and is willing to write a letter if I would like to take my mom to small claims court. I explained to her the situation and she is very mad, and now is getting an eviction notice for my mother. My mother had changed the locks so I couldn’t get in. I told the landlord about the grass, and she wasn’t even bothered. She even offered me another home she has for rent... and the way she made it sound, was she had more than just 2 properties. I have paid the towing bill and got the car back, does anyone think I should try to make a claim? Since at the point, the landlord had no care in the world that my vehicle was parked there, and didn’t tell my mother to have it towed.

I think you have a solid legal claim against mom for her illegal lockout and illegal tow ...but whether it is worth your time to wage that fight is beyond my crystal ball

Whether to file a claim against your mother or not is really a decision you have to make on your own. Even if you are awarded damages in a small claims suit, it will still be up to you to collect on the judgment.

Hey guys, sorry to keep bothering with questions. She paid the tow company $70 to get it towed off the lot. I was looking over the bill and they charged me another $100 for towing charges. Is that normal? I got the car towed up to my grandfathers, just down the road and they charged me $70 to get it towed there. Why $170 for the first towing charge? I finally was able to take a look at my car today, to see if anything was missing/broken. The car looked pretty normal until I tried to open the hood to see what the engine looked like. The car is an 03 bmw, so the hood latch comes out from the front. I went to pull up on the latch, and the one side of my hood barely went up. (It’s dark so it took me a second to realize that it was jammed and will no longer open. I had my boyfriend try to lift up, to the point he had the car rocking. It wouldn’t budge. I can’t open the hood, and I don’t want to break it because I don’t want to be accused of it being broken when they received the car. I’m not sure if there is anything I can do and the people I’ve asked, had no clue. :( there were parts laying on the ground when I finally saw the car so they obviously didn’t care. I have photos of the hood up, and obviously since it was being worked on, the hood went up and down before. I don’t think the tow company was expecting us to come pick it up.
