I have a 13 month old daughter i had to get a protective order against her bio father when she was five months old the order is good until 2007 he has never established paternity even when i was with him he never helped me out with her all he did was abuse us both (not physically) and always threatened that he was going to kill us he has a major drug and alcohol problem he is very unstable never works moves from place to place my question is i want to terminate his parental rights would i have to wait until the protective order is over?or would i be able to do it now?i know it is in my
daughters best interest not to have him in her life.she is finally happy and she knows me and my (new)husband love her and are there for her.he wants to adopt her hes been in her life since she was 5 months old.i dont know how to go about terminating his pr and if their is enough grounds for it he has not had any contact with her since febuary due to the protective order.i need advice on this situation please!!!

I told you that you need to get with an atty. Simply by going over your state statutes, you have grounds for TPR, however to get detailed advice, with your specific situation, get an atty.
