Proving a bio-mom unfit in Tennessee
I have filed to adopt my 7 yr old stepson. His bio-mom is contesting it at the request of her father. She was convicted of child neglect and has violated probation twice already. My son failed 3 drug tests at age 5 (marijuanna and cocaine). My husband has had exclusive custody for 2 years and she was given only supervised visits twice a month for 8 hours until she could prove stability and rehabilitation. She has showed up for about half of the visits when she is not in jail. She is also not paying support or going for drug counseling and drug tests like she is ordered to.
What grounds does Tennessee use in determining a bio-mom unfit? How long will the court give a bio-mom to rehabilitate, and is 2 yrs enough?
Any advise would be greatly appreciated.
