public embarassment

i live in a small town in upstate ny. we have a county newspaper that reports the last time a person had hicupps. in a maner of speaking. my son was in some trouble and this paper likes to give names and address,s . i have a private phone no, so i could keep my address private. if i ask them not to publish my adress over and over and they continue to do this do i have any legal recourse. this is a stressful situation . the embarassment and seeing these articles are really upseting me and my family who would like to keep our business at home. barb rosato

Move to a more crime ridden area so that your son feels at home and not out of place.

Is your son a minor? If so, they can not publish his name or his address. If he isn't a minor and has been in trouble with the law, it is freedom of the press, it's public knowledge. I know it's aweful, just try to grin and bare it until it hopefully blows over

Unless there is some strange law forbidding it (and I do not believe there is anywhere) the press can print virtually anything they discover with regard to the name and location of a person - juvenile or not. The laws may prevent, limit or restrict what government can release to the media, but they do not have any muzzling effect on what the media prints if they find out the information.

We have a similar newspaper in my area, and this is a constant problem. I sympathize, but there is little recourse. If they CHOOSE to cooerate, then you are lucky. If they don't, then they can do pretty much anything they can.

Juvenile names are struck from our local police reports, either as the victim or the suspect. The names of juveniles in relation to criminal activity routinely are NOT released unless convicted or charged as an adult. (this applies to the newspaper releases, and other public formatted material)

Sometimes the matter is totally out of an editor’s hands. Police in many communities will not release a juvenile suspect’s name unless he or she is charged as an adult or if the crime is a felony Some won’t release those names at all in an effort to protect offenders. And police may or may not release a teen-age victim’s name, depending on the seriousness of the attack.

Little wonder that newspaper polices also vary regarding the naming of young suspects and victims in stories.

Most newspapers will use the name of juvenile victims unless there is some concern about the safety or privacy of the victim — providing they can obtain the name from police.

Perhaps if you wanted to keep your business at home you should have also kept your son at home rather than out getting into trouble. Have you thought about doing something to improve his citizenship?

Take the newspaper articles and make large posters and put them up all over your house. Your son may actually get the message.

That is a good one HG! Also, buy the alarms that attach to doors for "Baby" making sure to get ones that prominately display the name of the "BABY" brandname :D that will make an impression with all his friends. :D
