What is the name of your state (only U.S. law)?
NEW YORK

I am a video producer and I was hired to produce a PSA for a melanoma foundation. This 30 sec commercial is going to air in NYC cabs (which is owned by NBC). There is also a chance that it will air on TV as well.

In the script, they want a picture of a tanning bed with the voice over saying "...and also, we recommend staying away from tanning beds because they dramatically increase your chances of skin cancer."

Are there any legal issues that I need to be aware of? After all, there are many tanning beds that do business in NYC. Are we allowed to say something like this? What is the name of your state (only U.S. law)?

Since the National Cancer Institute makes the same recommendation, I doubt that you should be too concerned. I'd use their exact wording to avoid instilling any personal opinion into it.

Your PSA should be clear as to who says that tanning beds increase your risk of developing skin cancer (as the source of this information is important), and if your PSA airs on television, you should be careul to avoid the display of any tanning bed or tanning lamp (or any other kind of) logo.
