And of course, none of it matters a whit because his failure to take 1.2 seconds to flip the switch to turn on the headlights is in no way mitigated by the purpose of the drive.

I would argue the actual number is closer to 0.5 seconds.

If you were driving at a time when headlights are not required, the officer had no legitimate reason to stop you for operating without headlights.

If the officer stopped you with no legitimate reason, that is a violation of your Fourth Amendment rights, and any evidence obtained subsequently can be excluded.

Placing you in handcuffs and transporting you to the police station sure sounds like an arrest to me.

What you need to decide is if it is worth challenging the stop and excluding the evidence. That's something an Ohio attorney would be better equipped to answer.

BTW, your proposed cross examination seems spot on, but I don't see where you were going with it.


The Cross Examination was meant to dismiss the citation I received for violating Ohio Revised Code 4513.04; Have no headlights. When the Correct Citation should have been 4513.03; Not Using headlights at the proper time.

The officer didn't even bother to ask me if my headlights worked or nor did he bother to check too see if they worked himself.

1. I have no pending DUI charge, so refrain from discussing that on this thread. (I had two 12oz. Beers, I weigh about 175 Lbs.)
2. I stopped by Taco Bell, to Get a breakfast taco, compared to walking to get the formula, I wasted 2 minutes, which like I said, my Son wasn't in Dire need, because I was drivign(BUT IF I WOULD HAVE WALKED, HE'D Be in extreme stomach Pain), but I needed to get the formula.
3. Look up the Ohio Revised Code before you start posting.

I guess you ended up wasting much more than 2 minutes in the end. pretty dumb given all you had to do was turn on your lights since it was still dark.

Nah. Not interested. Besides, the code alone isn't enough. You need to look into caselaw. If some judge once said a headlight isn't a headlight if it's turned off, any evidence you provide showing your headlights work would not help you.

The cop may have done you a favor by writing it up as an equipment violation. That may save you on insurance. Look into that before you start disputing it. A "driving without headlights" charge may jack up your insurance more than a "no headlights" charge.

You are going to acknowledge you were cited with the wrong offense but guilty of the offense the officer pulled you over for. That establishes his probable cause. So why are you buying beer for breakfast instead of formula for the baby? It sounds like the beer is likely the reason your license was suspended already.
