Question About Contempt....

Hi All!

My ex was found in contempt for willful non payment of child support in October and was given 60 days to pay up or go to jail for 180 days, or until he purges himself**************..My question is (he has not paid) on the next court date Dec 12th, will they haul him to jail when he shows up in court???
I really don't want him to spend Christmas in jail, but it appears as if the Girlfriend is telling him that nothing will happen to him (she apparently went through the child support thing through the state, and not a private attorney.. so it took a while for anything to happen for her, so she apparently thinks it is the same with a private attorney :rolleyes: ) I know he has the money he is just being an A** :mad: **************. Any insight would be appreciated!

It is really hard to know. Those who break "civil-family" court orders are less likely to get into trouble and likely to be given more chances.

I hope it works out for you. Keep us informed.

I will**************..This is getting very expensive and irritating...He has been behind on child support since the day it was issued**************.He even quit his job that he had, thinking he could become his own boss and not have to pay anything....I have paid more in attorneys fees than he has paid total....I really hope something happens, because obviously the judges displeasure with him isn't enough to get him to pay.....

On that note, even though your attorney may tell you differently, you have a right to be at the Dec. 12th hearing. You should not only be there, but request to be heard by the judge in order to plead your side. He'll go and tell the judge every lie in the book to get out of going to jail. You need to be there to counteract the b.s. Your voice needs to be heard to show the judge that it is, in fact, important to you that they enforce the court order. A great number of judges will do the "slap on the wrist" thing if only the NCP is in front of him/her. I've seen it time and time again. While I realize that you don't want him to spend Christmas in jail, I'd be willing to bet a lot of money that he'll suddenly come up with the purge amount. :rolleyes:

Oh...I will be there.....This is getting ridiculous...I know if he ends up going to jail he will all of the sudden find cash in his sock.....The judge already told him that he has to pay my attorney, and the same judge ordered two people to jail before he gave my ex 60 days to pay....So hopefully this judge will follow through......My ex seems to have to learn the hard way...
