Question About SIL's 101 Year Old G-Mother

Hello everybody! I am asking this question for my sister in law. She has a 101 year old grandmother who resides in Ohio with her daughter (SIL's mother). SIL's mother's health is failing, in hospital now, the g-mother is still in her daughters home, but being cared for by SIL's step-father. The daughter (SIL's mother) & step-father are arranging for the elderly g-mother to be placed into a nursing home, apparently by this Friday, June 24th. SIL asked me to post the question of how can she go about getting custody, guardianship, power of attorney, etc...SIL wants the g-mother to come to Arizona so she can care for her in her home, which she is very capable of doing (she used to do home health care), and she would like to know the first step she should take to get this done, and rough estimate of costs. Oh, BTW, SIL & her mother do not have a real "close type" relationship, actually her mother is a very unreasonable person (my ex-MIL:eek: ). The SIL's mother has power of attorney for g-mother, but as I stated her health is failing, been in & out of the hospital quite frequently as of late, has bad emphysema, and a failing heart. Any help would be greatly appreciated. Thank You in advance.

Your SIL would have to hire an attorney in the county where her granny resides and petition for guardianship over her granny. If appointed by the court, she then would have to petition the same court in OH for permission to move her granny to AZ and tranfer the guardianship to AZ.

Your SIL's mother will have the opportunity to contest the guardianship. Because she already has POA, that POA can have a clause in it stating that the current POA is nominated by granny to be her guardian/conservator. Because the current POA is doing the right thing and placing her granny in a nursing home, because of granny's age, and because of granny's health, I really do not see the court awarding your SIL in AZ guardianship over her granny.

Read your posts regarding your ex and hope he still is choking on his chicken. :D

Grannys health is pretty good for being 101 actually it is grannys daughter, who is also my SIL's mother, not sister. i know kinda confusing, but so is that whole family (cept' SIL)! SIL's mother (grannys daughter) is the one with the failing health & cannot properly care for granny anymore. I understand that a move to Arizona might be a little stressful on granny, but my SIL would take very good care of her. I just talked with SIL, and she is concidering moving back to Ohio just to take care of granny, not a bad idea if she can do it. So anything else?

Her going to OH is a much better way.

SIL moving to OH is better idea, the stress of such a move away from everything Granny has known, even the hot summers might be too much. Why AZ wasn't even a state when Granny was bornm I looked it up! :) The statehood date / date of admission for Arizona is Febuary 12th 1912.

Oh BTW, my ex-fiance has made a quite generous offer for ME to buy HIM out for the very small sum of $7,000.00 + take his name off the mortgage, I have it on DVD because he would not write it out & sign it, wanted me to do it for him...I ain't that crazy ;) I would jump on the offer in a NY-minute cept that my credit is d**ked, no thanks to him, so I don't know how lenient a VA loan might be with janky credit. :confused: Hmmmm....that is strange that the 7G's is exactly what I have been saying all along that he has put into the house :rolleyes:

WOW! I can't even begin to imagine being that old, everyone you ever knew would more than likely be gone, which is the case for her except immediate family

Maybe he'll take payments $50 per month :)

7G's is not a problem at all, I could come up with that, it's getting a loan that is the issue for me.
:( I would love to keep this house, it kills me to leave a house I have completely redone yet again :mad: :(
