My friend has a 14 yo daughter that visits every other weekend. While she visited this weekend, her & her mother got into it and the girl threw a "temper tantrum" @ 1am in the morning. Mom caught her on the phone talking to some boy.
Well, the daughter proceeded to start slamming doors, yelling and stomping around. At 3am, the police arrived over a domestic dispute. They walked the apartment, all was well and asked if there were neighbors that there were disputes with. Well, the friend had reported the downstairs neighbor to the landlord about a month ago for making noise late & night & waking up her baby. Come to find out, this neighbor is the maintenance man.
Well, the landlord called today & told her that she needed to pack her stuff & leave. That her baby (14 months old) was loud & that he had received complaints on the noise in the apartment. Last night was the first she had heard that she had been complained on. Well, her response was I have paid my rent, you can't just kick me out. He responded that he would give her 30 days.
She plans to move, but the question is, will she be able to get her security deposit back? He has never notified her that she was a "problem tenant" and before last night, she had not had any problems. The landlord commented that she was a problem because he had to come twice to fix her toilet (not her fault, the float was bad & he didn't fix it correctly the first time)
She is on a 1 yr lease, she has only occupied the property for 4 months. What is the name of your state (only U.S. law)?
