I have a friend who has rented a house for just over 1 year. She is from Canada and her visa is expiring soon and she needs to leave the country by April 16th. She signed a 1 year lease which expired about 2 months ago. A new lease agreement was sent to her, but she never signed or sent it back. She just kept paying the monthly rental rate. She has now given 30 days notice and paid for April's rent. The landlord says he is charging her 3 to 4 months rent due to breaking the lease. Again, no new lease was signed after the first 1 year lease had expired. Is she liable for the added expense or is it assumed that the lease turns into a month to month lease after the original 1 year lease expired?

Unless it states otherwise in her lease, it usually reverts to a month to month lease after the initial term of the lease. 30 days notice should be plenty.
