What is the name of your state? Connecticut

Hey girl! I have a quick question for you (or Beth or anyone else who might know). My co-worker and I are having a disagreement. She thinks that it is required by law that if a person works 8 hours or more that they are entitled BY LAW to receive a certain amount of time for lunches and breaks. While I'm pretty sure that a company has to at least give 30 minutes (that's just a guess on my part), I think she is wrong that an employer has to give "45 minutes for lunch and two 15 minute breaks".

What does the law say? Thanks.

Well, hey there! Where you been, girl?

Federal law does not require ANY breaks for the adult employees of private employers. The only caveat is that IF breaks are offered, breaks of under 20 minutes must be paid breaks.

Connecticut does not require any rest breaks whatsoever. A meal break of 30 minutes is required by state law for those employees who work a 7.5 hour shift or longer. This meal break must be taken after the first two hours of work and before the last two hours of work.

For the record, NO state (with the sole exception of SOME hotel workers in Illinois, from a law passed in the current calendar year) requires two fifteen minute breaks for the adult employees of private employers. A very small handful of states requires ten minutes for every four hours of work, but CT is not among them. Additionally, only NY has a 45 minute requirement for a meal period, and even in NY it's industry specific.

Here are some links:

http://www.dol.gov/dol/topic/workhours/breaks.htm

http://www.dol.gov/esa/programs/whd/state/meal.htm

http://www.dol.gov/esa/programs/whd/state/rest.htm

This represents the sum total of state and Federal law on the subject of breaks. If you don't see it on one of these links, it doesn't exist. Of course, this does not take into consideration any breaks that may be required by union (or other) contract. But that's contract law, not employment law, and is negotiable.

Hope this helps!

Hi, you two. I've been busy moving from Wisconsin to Connecticut, starting a new job and some other personal stuff. I stopped coming here mostly because I just rarely have the time. I check in maybe once a month to see what's going on over in the banking section, but it looks like it's pretty well covered so I'm not as needed as I used to be. :(

Thanks for the answer, cbg. I appreciate it! See you both around. If Beth is reading this, hello to you too! :)

I've never heard of a minister who uses the Lord's name in vain. I guess this loser is a liar as well as a dead beat. :p

hmmmmmmmmmmmmm???;) It's official now, This so called "Betty" has the power on this forum to delete posts as she wants. This whole thing is so comical. I worked with "Veronica" at an office years ago. Used to sit in front of a computer and eat candy all day. She's about 220 lbs.and has a mouth the size of Columbus, she would never shut up. She has no legal knowledge whatsoever. She's teamed up with "Betty" here as two bigmouth Know-nothing-at-alls here on this forum. She must of worked with her at one time. Both shouting out there narrow minded opinions, Betty and Veronica hmmmm? Boy Archie and Reggie couldn't lift these two lugs. This forum has no legal merit at all folks if these two together have over 10,000 posts on it.
