What is the name of your state? New Jersey.
Thank you Beth3 for response to "Is employee liable for damage to work truck." :) CBG - Beth3 suggested you may know the answer to this question. I have unsuccessfully navigated the DOL site here in NJ. Is an employee liable for damage to an insured work truck if the damage is less than the employer's deductible? My former boss is holding my paycheck saying I have to get an estimate on the scratch repair the truck needs and pay for the damage out of whatever pay I would have left because it was my fault. If I file a complaint with the DOL for back pay, will he succeed in filing a complaint against me? :o

I can tell you that he cannot hold your paycheck until you get an estimate. I can tell you that he cannot deduct the cost of the repair from your paycheck.

But whether or not he can hold you responsible; whether or not he can require you to pay for the damage, is beyond the scope of my source. You'll have to contact the state DOL on that one.
