What is the name of your state? Case in NJ

Situation: Father had custody of three children since 1989. Mother became in arrears for child support as she never made payments. All children are now grown and mother has been paying arrearages for quite some time. Mother is approximately $20K in arrears. Father has been collecting arrears from mother. Father passed away in May.

Questions: What now happens to the arrears?

Basically they are gone. It might be possible to argue that the debt is still owed to his estate, but I have never seen it actually work out that way.

Just an update and something to think about!

The way that this has played out is that Mom is still paying on arrears (paying to the estate) and the money is supposed to be divided between the children. I am unsure if it is only because mom is too lazy to file something against it (I doubt this as mom was constantly tring to get dad to forgive the arrears while he was alive) or if this is the way it works??????

Basically they are gone. It might be possible to argue that the debt is still owed to his estate, but I have never seen it actually work out that way.

Mom is still paying! Father has been gone since May 2006.

I would think that the children are still owed the money! Pay your bills...... Its not the fault of the children that their dad is gone! Why would you feel that the money is now not owed? Pay the estate of the fathers... I am sorry that he died, but I feel that maybe you are looking for a way out of your debt here. Pay your children the money due them**************

Okay, Mr. Doesn't-Have-A-Clue. I'm going to say this once:

Child Support DOES NOT belong to the CHILDREN. It is to REIMBURSE what the CP spent to support said children.
