I had a couple of questions. On another thread a poster was asking about the possibility of losing visitation if the NC parent does not exercise their Court Ordered Visitation.
My x has not seen our children for about 1.5 year now, he has not spoke to or emailed them since Sept. 2007. He lives out of state and has visitation in the summer and every other holiday. He was, until just recently, an over the road truck driver and anytime he would call and say he was in the area and stopping by the kids were always made available to him, always. He has not taken the kids on his own, since the summer of 2000. What I mean by that is he visits them at my house. Not because he has to, it's not court ordered that way or any other reason, he just does. It's rather odd. But my husband and I decided if that is the only way he was going to see the kids, and they definently wanted to see their dad, then we would put up with it. Usually it was only a couple of hours but sometimes he would stay all day.
If you read my other thread you know I am in the middle of a contempt/enforcement case with him. He called me Monday, while the kids are in school, never asked about them once, it was all about him, how much his life sucks, on and on. Anyhow, on that note, it looks like we will settle our case.
Another poster said that a NC could loose their visitation for not exercising them on a regular basis, I would assume alot of factors would come into play with something like that? Above all, what is in the best interest of the children. My children are 17.5 and 12. Having dad come in and out of their life is nothing new to them, the longest they went was almost a year, or a little over a year don't remember now how long. I asked him why, why did he do it to them again, no phone calls over Christams, nothing, he tells me "I was testing them". Say what? "testing them, and they failed". I guess to see if they would call and write him. Which they did, but around the end of October they stopped calling and leaving messages, they got discouraged.
