I have recently purchased a piece of property in which I intend on placing a modular home. The property boarders as shown to us just didn't make any sense according to the land platt we had recieved. I contacted the original surveyor of the subdivision and asked him to do a survey of my lot. After the survey was completed we found that the right side of our property (if you are facing it from the road) extended past my neighbors driveway and an additional 5+ ft in they're front yard. We have spoke with the neighbors and are unsure what to do. We all agree an error has been made when they're house was put on the property but are not sure who is to blame. The property was purchased originally by Oakwood Homes who then proceded to put a home on it and then sold it as a turn key project to our now current neighbors. They have contacted Oakwood who has placed the blame on the realtor, and the realtor has placed the blame on Oakwood. The realtor told the buyers that they're property extended appx 10ft on our side of the driveway when actually it is appx 20 ft in the other direction. We are all at a loss, we (ourselves and the neighbors) are trying to work together on this. We all realize it is of no fault of our own. We are just trying to protect ourselves and make a home, and they purchased a ready-set home that was set inappropriately. The home in question is on the utility easement and if we put our house on our adjoining property it is too close to they're exisiting home. What should we do? Any thoughts or suggestions?
