What is the name of your state? CA

I am a manager of a production facility, an exempt position, paid salary. If i quit during the first few days of a pay period, does my employer have to pay me my full wage (2 week) even if i'm not there working? Or can they pro-rate the salary?

Would I be eligable for cobra benifits if i quit? I am assuming i will have to wait 3 months on my new employer benifits to kick in?

Thanks for your help!

You would only be due pay for the days you actually worked. There are a few exceptions to the law that says an exempt employee must be paid for the entire week if he works any part of it; one of those exceptions is the last (and the first) week of employment, if the entire week is not worked.

You would be eligible for COBRA IF you have already joined the plan at the time you quit. If you are still in a waiting period and are not yet participating, then you would not be.

Whether or not you would have to wait three months for a new employer's benefits to kick in, would depend entirely upon the plan. Not all employers have a 90 day waiting period; in my experience, benefits generally start much earlier than that. Industry and region of the company vary, but my point is that the LAW does not require a 90 day wait.
