Raising rent at end of lease

What is the name of your state (only U.S. law)? Michigan

My lease expires on April 1, 2010. I heard from the landlord today. She intends to raise my rent on that day.

Is she required to give me a 30 day notice of her intent to raise the rent, or does that not apply since the lease is ending?

Does your lease auto convert to a month to month when it ends?

What does it say about ending the tenancy at the end of the lease?

Simply, yes.. you are entitled to 30 day written notice of the increase of rent. If she doesn't do that, yet expects a higher rent for April or may, you don't have to agree, just pay your regular rent.

If you don't agree, yet she properly serves you, then you are free to move with a 30 day notice.

The law in Michigan is very clear with regards to a landlord’s right to raise rent. Since you have a lease, your landlord can not raise your rent until the lease has expired unless there is specific language in your lease that allows for an increase in rent while under the lease terms. Your landlord can raise the rent provided that he gives you WRITTEN notice at least one rental period in advance. Verbal notice is not valid, only written notice is allowed. If LL provides you with written notice of a rent increase without having given proper notice at least one rental period in advance, you will be responsible to pay the increased amount the following rental period.

Given that it is already mid-March, and the LL has indicated that he expects to raise the rent beginning next month, he is going to have a problem enforcing that. First, because he did not provide sufficient notice in advance (he would have had to give you written notice of that increase on or before March 1st to become effective as of April 1st), and second because he has not provided notice in writing (sounds like he may have told you, but the notice MUST be in writing to be effective).

You can hold firm on your rights, but he can then give you a written notice for more than what he was intending to charge without proper notice. You then have the option to leave or stay with the new higher than originally intended increase.

Does your lease provide for an automatice increase at the end of the term? If so, you've been given MORE then sufficient notice, you probably just forgot about it. Read your lease.
