Random Collection letter received

I received a collection letter last week from a collection agency that I had never heard of in Colorado. After calling the collection agency, they told me that I owed $308 stemming from a bank acount that I had opened in 1999 while living in Ohio. Still feeling a little unsure about the whole thing (the bank name was just not ringing a bell to me....but I had accounts with several banks at the time), I called the bank directly. They had my information and address at the time, so I knew then it must have been an account that I had opened. The person I had spoke to had also told me that the account was closed on January of 2001 (2 months after I had moved out of state). They were not able to tell me why this money was owed, and I dont believe I had left owing any money to them. I plan on sending a letter of dispute to the collection agency, but wondered if I can also claim this as a statute of limitations issue seeing as how it has been 6 years before they even made effort to contact me. I have checked statues for Ohio, Virginia, and even Colorado and all of the time periods for statute of limitations is well below 6 years for open accounts. What is the best way to handle this as far as disputing the claim??

The SOL has probably NOT expired for that account. The clock for the SOL tolls (is put on hold) when you move out of state.

So, unless you told the bank about your move to VA, I would expect you would have a hard time convincing a court that this is a VA debt.

For your own knowledge, put your request for information on the bank account in writing and send it to the bank.

To protect your rights, send a validation request letter to the collections agency.
