RCA TV Set Failed 3 days after it was purchased

:mad: I bought a RCA 27in TV set in Jan 18 2005 and the tube failed the first week. KMART said because it was a floor model demo they can not take it back but it was under warranty. It took almost a month for the service tech to come and diagnose the problem. And almost 2 months to get a picture tube from RCA. While the TV was being removed the men scuffed the case which they said they would replace. I get the TV back and as the damage to the case is still there and the picture is worse now. This has been confirmed by another visit by the tech man on May 2 nd. As it stands today, May 16, the TV is in my garage waiting pick-up. I am back to using my 1983 20in Sony Trinitron that never seems to die. The repair facility has been saying over a week they are waiting to hear from RCA/Thomson tech people about the problem and they are often curt when I call. In March I called RCA/Thomson and pleaded with them to replace the unit or give me a refund. I Had my pre-paid legal provider send them a letter which they ignored. Pre Paid said I can file my myself in small claims court but the court costs here are almost what the TV cost. Any suggestions.

Hee hee hee. Prepaid legal. What a joke. Yes you can file in small claims court and guess what, prepaid legal gave you incorrect info. You can ask for the expenses of filing the lawsuit too. That is if you win. Now you just have to figure out who to sue and you will then be in for another surprise.
