My husband and I separated at the beginning of 2001. Our divorce was finalized in July of 2001. He has been paying me spousal maintenance (not court ordered) but volunteered.

He has been paying me all year long from January.

In regards to "TAxable Income", is it considered taxable income for taspurposes when the divorce was finalized in July or or when he begun giving me money to live on from January. I still don't have a job, with two small children.

I need help clarify this question.

:rolleyes: You must have a legal agreement that calls for the support such as a Marital Settlement or Separation Agreement. Then, you cannot have been living together or in the same residence to claim it as a deduction. Any type of "oral agreements" do not count. Also, the payments must be in cash or cash equivalent. Payments to pay bills or a mortgage can qualify but this should be specified in the Agreement. Also, the payments must stop when the receiver dies, but, this is mostly assumed under the state laws of most states.
