The city tore down our family home without giving us proper notice. My brother had been making the necessary repairs to the property and had appeared before the city council when ever notified regarding property. They were well aware of the work that was being done on property. During the council meeting that they decided to demolish the home, we were not notified by mail to be present at the meeting. They have admitted that they did not notify us as we have asked for and gotten records that clearly indicate that they did not notify us a required by law. They offered my brother a nominal amount to settle over the phone and we would like to know what damages can we claim for the demolition of the property. (Compensatory,Punitive etc) The house was vacant and no one lived in property. Under the state law we could sue the city for up to 100,000. Could we sue them in Federal Court(Due Process) as well as state court? My brothers and I have lots of memories from living in this house. There are numerous houses in this area that were in worse shape than our, but not demolished. This is a area that's being redeveloped and has a historical designation. The assesed value is around 9000.00 but the value to us is so much more. We would like to know on what basis could we file suit for the maximum amount allowed under the law.
