Does anyone know what the laws on recording telephone conversations are?

My ex was leaving a message on my voicemail...no big deal....but when he THOUGHT he hung up his phone I head him say to someone..."I record all my conversations with her"

I have never consented for him to record me on the phone...and have told him in the past that I don't agree to it period....

It is unlawful to use a recorded phone conversation for any legal action unless you have given your consent. That also must be proven that you gave consent usually by written permissin or oral recorded permission.

In most states it's legal as long as one party to the conversation knows the conversation is being recorded. If Florida is one of those states I doubt it would matter if you told him you did not "consent" to the taping as in the one party states that consent is irrelevant.

I don't know what Florida's law is in this regard. However, if it's the same as a majority of states there's probably nothing you can do except be careful in your conversations with him.

That kind of blanket statement about the law isn't accurate. It depends on state law. In most states the recording of the conversation is legal as long as one party to the conversation knows of the recording.

Now whether the recording can be used in other legal proceedings is another issue entirely. However, the OP didn't ask about that.

Why? Because I am an INDIANA attorney. I do not give advice on other state's laws. Nor am I inclined to look them up for people. But if that advice came from you, I hope the OP knows that you are NOT an attorney and he should get advice from someone who knows Florida (as opposed to Floridian) law.

Well according to the web site that I referenced in my previous post...florida is a 2 party/all party consent state....

I have also learned tha alot of people do not understand the one party consent law in the 38 states that have the 1 party law

Florida is one of the 12 states that has a 2 party/all party consent law

That's a direct cut-n-paste from the site, NOT something you have learned. And if you would look closely at the site, you would notice that it has not been updated for two years.

The laws have changed drastically along with case law and federal statutes.

And even in states where only one party consent is needed, that condition pertains to VERY SPECIFIC conditions. And two/all party states are not always such under other circumstances.

AND, you have given no indication that your particular circumstances nor those under which your ex is recording his calls are illegal.

Get the point?
 
My particular situation is that my ex desperatley wants to find me in contemt of court!!! He would love nothing more...those are his words....I imagine he is taping all phone conversations in case I say something unfavorable which he would turn around an use in court!!!
