In a divorce case, can one spouse use a recording of his or her telephone conversation with another spouse? In Texas, there is one way consent whereby one person can secretly tape a conversation with another. However, I am not sure if any kind of "spousal privilege" prevents it from being used in divorce cases.

You can use it if it is a one party state and you are certain and can prove that the other party was also in the state and not outside of the state. Whether such a recording would be credible or there would be other problems with getting it admitted is unknown.
