What is the name of your state?PA

My cousin was recently fired because of an employee that complained she was sexually harrassed. The company has a no tolerance policy and fired him on the spot. What did he do? He walked up behind someone who looked tired and rubbed thier shoulders. The reason I know this was no intended as SH is that he does this to his own mother and brothers. He slow with CP. Under what conditions can a company fire an employee for percieved SH. They are also trying to deny his Unemployment Comp. Thank You

From your description he should have been fired under the circumstances. He does not have the right to touch anyone without their permission. That's what zero tolerence means.

Your cousin just learned a valuable lesson.

Sexual harassment is not determined by the intent of the alleged harasser, but by the perception of the "victim". As Belieze says, he has no right to put his hands on someone without permission, regardless of his intent. The company was absolutely within their legal rights to fire him.

Under what conditions can a company fire an employee for percieved SH. Under any circumstances whatsoever in which the company has a valid reason to believe that SH may have taken place. In fact, they can fire someone for perceived SH any time a complaint is filed if they choose to.

I know that the answer you want to hear is that they can't fire him unless they have proof positive that he intentionally harassed someone, but that is not the case.
