I work for a big grocery company as a delivery driver for ecommerce. My supervisor keeps harrasing me after I told management for many weeks. They are not doing anything. I am muslim and when he calls me he tells out ALLAH AKBAR, and pretends to have a middle eastern accent and says stuff like hello this is Osama bin laden may I speak to michael. He also has sent me many texts that mock my religion and me. For instance he took a picture of me when I started work there in 2018 in the corperate training room. I never knew he took this picture. He then cropped it and attached islamic writing and a picture of a gyro. And the list goes on. Do you think this is a strong case for the EEOC and worth filing a charge. I have seeked out both human resources and upper management but no one is doing anything about it.

It sure sounds like you have good reason to file a complaint.

Before you do anything else, however, report your supervisor to HR at corporate. If they take action, so much the better. But your claim with the EEOC will be that much stronger if you have exhausted all possible in-house remedies first.

I have already done all of that. HR has ignored my last 2 calls and I emailed the director and asked to speak to him but he said he was too busy with meetings but would call.me asap. It has been about 3 weeks now with no one calling me.

If you have made a complaint to your employer’s HR department and nothing has been done to address and correct the supervisor’s behavior, you could file a complaint.

Thanks I think I am definitely going to file a EEOC complaint especially since I have a lot of proof via text. And it seems because I keep pushing the issue they are retaliating against me for complaining by cutting my hours before I complained I was getting 60 plus hours a week now that I complained I get about 32 hours only.

You might want to discuss your working conditions with an employment law attorney in your area prior to filing your complaint.

Yes, I agree it sounds as if you're in good shape to go to the EEOC. That is blatant harassment IMO and HR should have put a stop to it straightaway. I agree that a consultation with an employment attorney isn't a bad idea if only to help you put the strongest case possible together.

Thanks for all the advice. I spoke to a employment lawyer about 30 mins ago and showed him all my evidence. He also agreed and I am taking him up on his offer. He is putting the EEOC charge paper worl together now and after I sign and notorize he will submit. My only question is he said it could take months or years before it even gets investigated so it is basically just a waiting game at this point.

That's true; discrimination claims are not quick or easy. But the employer will be most likely put on notice that there is a claim probably within the month - maybe a bit later because of the holidays. It will be interesting to see if anything changes once they have that notice.

Your employer, as a note, is prohibited from retaliating against you (firing you, harassing you, etc) for filing an EEOC complaint.
