An employee of mine had an accident. There is supposedly this company policy that prohibits anyone in a driving position for the company from driving if they have 2 vehicle accidents.
No one has seen this policy being quoted, signed documentation referencing the policy, neither can HR provide it when requested.
The second accident he had was due to another person cutting him off and subsequently slamming on his brakes, causing my employee to attempt an evasive maneuver when he realized that he was going to rear-end the man who just cut him off. He swerved to the shoulder of the road, lost control of the vehicle and end up hitting someone on their passenger side door.
The deputy made certain not to assess fault or issue a citation to him, because even he said that it wasn't his fault, but the company was going to have to pay for the damages.
Our upper management have removed him from site pending an investigation, however, it's going on two weeks and they have not even spoken to this young man. They've made the decision to not return him to this job site, and can't seem to locate him any alternate sites to work at that are non-driving.
I believe what they are doing is unjust and want to know if there is anything that can be done about, short of filing with TWC.
