Carbon County Utah

I have been divorced for 2.5 years.

We both have joint coustody, My ex has physical coustody. I have visitation every other weekend and can call them every night from 7-8 pm

She has moved countless times and not provided me with an address or phone #

I moved to WI for about 1 year and am back in Utah now

About 2 years ago I was in WI and had not spoke with my kids for several months. A member of her family contacted me and told me my kids miss me and wanted to speak to me. They told me my ex and her boyfriend and 6 kids were living in a motel room and gave me her cell phone number.

I waited until 7:30 that night and had my friend call and get my son on the phone. At then time the phone was handed to me. I said " Hi this is dad." My son was excited to hear from me and said "DAD it so good!" and the phone hung up.

I called several of the motels in the small town and located them. They could not connect me to the motel room at that time.

The next day I called the number I had for my children and the number was not in service.

Several days later I was served with a restraining order.

I could not goto court for the hearing in price utah because I did not have the money on hand for the plane ticket.

I wrote a letter to the court explaining the situation but that did not help.

The restraining order has now been put in effect permanantly.

I have tried sending forms to the court to get the judge to look at the order. The court send me letters back stating that it will not be reviewed at this time.

It has been over 2 years since I have seen or spoke to my kids and I miss them horribly.

The ORS takes child support from my check every payday so I am paying child support but I can not see or speak to them.

Also my ex will not let my family see the kids because she says they my talk to my kids about me and she does not want that

I need help to get this order removed please

Thank you

You have had a PERMANENT restraining order placed on you for calling your child?
What are the reasons that your ex claimed when she requested the RO?
Is there a history of DV?
Why was it that your asked a friend to call and ask for your son?
Have you filed for Visitation/ Custody?

The court told me the order does not expire
I cant find my copy of the order at this time but to the best of my memory she was claiming I was calling her friends and family and her non stop I belive she claimed stalking, But I was 1500 miles away.
The reson I had my friend call is because if I was to call she would have hung up on me. With my friend calling at least my son knew I was trying to call him.
I have joint coustody and standard vistation but the order is in place so I cant exercise it.

You need to go to court and have the Custody order modified to accommodate the RO. Hire a Lawyer to help you.

Yeah, um, this is NOT the whole story.

Dad needs to explain the whole hadn't spoken to his children in months thing. And how it's possible that a permanent restraining order barring him from his CHILDREN as opposed to his EX was put in place.

This man STILL HAS visitation and joint custody. Unless the restraining order specifically bars him from seeing his children, he's CHOSEN not to exercise his visitation all this time.

My ex has a restraining order against me. Doesn't stop visitation. In fact, it makes visitation/exchanges EASIER than I would have thought possible.

OK to explain further

The restraining order that was put on me over 2 years ago includes my children so I cant have any contact with them

I would love to contact them if it was possible
