This is going to be a long post. A very long post. Further joyness is that I will be making another, probably longer, thread to address a seperate problem. I do hope this is a patient message board.
We have had problems with this apartment management literally since the moment after signing the lease. We live in Florida for any relevant law and I've read Title 6, chapter 83 and can't quite find where some of this is directly applicable.
We were offered six weeks free rent as a move-in bonus. We notified them that we would sign a lease on Jan 1, 05 and did so. We paid rent and deposit, my husband signed his copy and then I was given my copy. I'm the one who reads everything and I noticed that they had us moving in (and paying rent from) Dec. 27, 04. I questioned this and lease agent said that the six weeks free promo ended on Dec 27th, so if we wanted it we would have to pay the extra pro-rated rent from that date. My husband had already signed and there is no out in FL once signed, so it was already a done deal. I was still somewhat ticked about paying without being allowed keys until we actually moved in, but whatever. Four days extra paid in return for six weeks free and the husband was already responsible under lease anyway. I signed.
On Feb 1, 05, the management demanded February's rent in full, despite the six weeks free promo. I questioned this and they said that we could wait until Feb 11, 05, to pay the full amount of the rent. I assumed this would then simply make our rent due on the 11th of every month. It wasn't to be. On Mar 1, 05, they again demanded the full rent. In summary, we did not get the six weeks free. I checked the lease and it specifically states the six weeks free were to be from 12/27 through 02/06.
I keep my doors, windows and patio locked and bolted at all times. Two months ago, while I was home during the day with the children, an unknown person unlocked my front door and tried to enter the apartment. I yelled in fright; the security latch held and the person closed the door and presumably left. I called the management, assuming that they would have known who had copies of my keys. They said they would look into it and call me back. I never heard back.
One month ago, someone again unlocked my front door and tried to enter my apartment. Again, I yelled; the security latch held and the person went away without a word. I called management once more and was told that this was the pest control service. I had not requested nor did I need pest control and told them as much. The management said that pest control enters all apartments regardless of who needs it. The management gives them the master keys. I (rather indignantly) pointed out that I had no notice and management replied that it was written in our lease that they would come in to spray whenever they cared to. I informed them that, nevertheless, they had best understand that walking into the locked home of a gun owner was not the course of prudence and I would call the police the next time my home was trespassed upon.
I called the management last Friday over aforementioned seperate issue, also known as The Last Straw, looking to file a complaint about everything. The woman I spoke with said that she knew nothing about the how the other issues were handled and would leave a message for those people to call me back. She also refused the complaint in regards to entering my home without written notice, an existing work order or emergency. In her words - and I quote - it is written into the lease that they can enter my home for any reason and at any time. I read to her the state law, directly counter to that, and she said the lease overrode it. She also said - and I quote - that if someone unlocked her front door it wouldn't bother HER in the slightest.
Riiiiight.
So. Any ideas? If you're especially bored after you finish giving me ideas, you can always mosey on over to the other thread. It'll be up momentarily and that's a heavier issue. Thanks for your patience, I do appreciate it.
