I'm renting a condo in West Palm Beach and was presented with a letter from the condo association addressing a "Garnishment of Rent". Turns out the owner of the unit is in arrears on HOA fees and the association is now advising renters to pay their monthly rent to the management office until the unit owner is up to date with the dues.

I obtained a Certificate of Amendment to the Declaration of Grand Isles Condominium Association. I'm being told by the association that if rent isn't paid to the management office that they can evict me. I'm also being told by the landlord that if rent isn't paid by him that he can evict me. So I'm not clear on what laws protect me and who I'm to pay rent to. I'm in a lease and have paid my rent on time, but don't know who to pay next month's rent to. I'm in a disgusting situation and am running around in circles with this matter.

Is the condo under "receivership"? If so, they can direct the tenant to pay the HOA their dues. If there are any monies left over, those are then sent to the landlord. The key is the receivership. (Thank you Charlie Crist for this.)

So, I'm going to write to their attorney and copy my landlord; outlining that I've had a lease since November of 2009 and this amendment was put into effect February of 2010 so how is this to affect me and where is a court order directing me to redirect my rent to the HOA instead of my landlord.

**A: I am sure it makes no difference when your lease started since the court order would be effective currently.

If there is a court order for blanket receivership, the Condo HOA needs to provide to BOTH parties (Landlord and Tenant). Because of the foreclosure issue down here, it's become an avenue where the associations can continue to run.
